Last reviewed 2026-11-04 Applies to: PPADA 2015 sections 167 to 175; time limits are strictly applied

Short answer: a bidder who is aggrieved must file a request for review with the Public Procurement Administrative Review Board within 14 days. Later steps also have short statutory deadlines.

StepTime limit
Request for review to the Review Board (section 167(1))Within 14 days of the notification of award under section 87, or of the alleged breach at any stage of the process
Review Board decisionWithin 21 days of receiving the request
Judicial review in the High Court (section 175(1))Within 14 days of the Review Board's decision
High Court decisionWithin 45 days of the application
Appeal to the Court of Appeal (section 175(4))Within 7 days of the High Court decision; the Court of Appeal decides within 45 days and its decision is final

Why timing matters

Kenyan courts and the Review Board have struck out requests filed outside the 14-day window. Do not wait for a debrief, and keep proof of when you were notified and when you filed.

Practical steps

  1. Note the date you received the notification of award or noticed the breach.
  2. Read the relevant provisions of the Act and Regulations (the Board's decisions refer to regulation 203 of the 2020 Regulations).
  3. Take legal advice early, because the deadlines are short.
